Terms of Use

These terms are the agreement between you and Soul Care Dashboard. We have written them in plain language, so you can actually read them and know what you are agreeing to.

Soul Care Dashboard ("Soul Care Dashboard", "we", "us", or "our") is a software platform provided by Gospel Soul Care Ministries. These Terms of Use ("Terms") govern your access to and use of our website, applications, and services (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

๐Ÿค The spirit behind the fine print

An agreement is, at heart, a set of promises kept in good faith. We would rather our promises to you be clear and honest than clever. So while this page uses the language it needs to, our aim underneath it is simple faithfulness in how we serve you and the people in your care.

๐Ÿค 1. Agreeing to these terms

By creating an account, accepting an invitation, or otherwise using the Service, you confirm that you have read and agree to these Terms. If you are using the Service on behalf of an organization, such as a ministry, church, or counseling practice, you confirm that you are authorized to accept these Terms for that organization, and "you" includes that organization.

These Terms work together with our Privacy and security page, which describes how data is handled.

โœณ๏ธ 2. What Soul Care Dashboard is

Soul Care Dashboard is software that helps soul care and counseling ministries run their work. It provides tools for scheduling, session notes, secure messaging, intake and consent forms, homework, and payment and billing administration.

Soul Care Dashboard is a ministry and soul care platform, not a medical or insurance-billing system. We provide software; we do not provide counseling, medical care, legal advice, or emergency services. The Service is not a substitute for professional medical or mental health treatment, and it is not for use in emergencies. If you or someone you are helping is in crisis or danger, contact your local emergency services or a crisis line immediately.

๐Ÿ›ก๏ธ 3. Who provides the care, and who provides the software

This is the most important distinction in these Terms. The counselor, ministry, or organization using the Service is the care provider. You are responsible for the care you give, for your professional and ethical obligations, for any licenses or credentials your work requires, and for the data you collect and store about the people you serve.

Soul Care Dashboard is the software provider. We host and process your data to run the Service on your behalf and according to your instructions. We do not direct, supervise, or take responsibility for the counseling relationships, decisions, or outcomes that happen through your organization.

You are responsible for obtaining any consent required from the people you serve, for handling minors appropriately through a parent or legal guardian, and for meeting any reporting or record-keeping duties that apply to your work.

๐Ÿ‘ค 4. Accounts and eligibility

Accounts are created by invitation or approval. To hold an account you must be at least 18 years old and provide accurate information. The people you serve, including minors served through a guardian, are not account holders in the same sense; they take part through the access your organization gives them.

You agree to use the Service lawfully and in keeping with its purpose. You agree not to:

๐Ÿ” 6. Your data and the people you serve

The data your organization puts into the Service, including client information, notes, messages, and forms, belongs to your organization. We process it to provide the Service, as described on our Privacy and security page.

You are responsible for the accuracy of that data and for having a lawful basis and any needed consent to collect and store it. You grant us the limited permission we need to host, back up, transmit, and process that data so that the Service can function for you. We do not sell your data, show ads, or use your counseling data for anything other than running the Service.

๐Ÿ’ณ 7. Plans, trials, and payments

Some parts of the Service are offered on a paid subscription. If you start a free trial, you may use the included features during the trial period without charge. When a trial ends, or if a subscription lapses, your organization's account moves to a read-only state: you can still view your existing data, but new entries are paused until the subscription is active again. Your data is retained during this time, not deleted.

Subscription payments to Soul Care Dashboard are handled through our payment processor. Payments that your organization collects from the people it serves flow through your organization's own connected Stripe account, not through us. You are responsible for any taxes that apply to your use of the Service. Except where required by law, subscription fees already paid are not refundable. We may change prices, and if we do, we will give reasonable notice before a change takes effect.

๐Ÿ”Œ 8. Third-party services

The Service works with trusted third-party providers, including Stripe for payments, Google for calendar and sign-in, Zoom for video sessions, Cloudflare for hosting and security, and Resend for email delivery. When you connect one of these, you authorize the Service to exchange the limited information needed for that feature to work.

Your use of those third-party services is also subject to their own terms and privacy policies. We are not responsible for third-party services, and their availability can affect features that depend on them.

ยฉ๏ธ 9. Ownership

We own the Service itself, including its software, design, and content, apart from the data you put into it. These Terms do not transfer any of our intellectual property to you, and you may not use our name, logo, or branding without permission. You keep ownership of your organization's data as described above.

โš ๏ธ 10. Disclaimers

The Service is provided "as is" and "as available". While we work hard to keep it secure and running, we do not promise it will be uninterrupted, error free, or fit for every particular purpose. To the fullest extent allowed by law, we disclaim warranties that are not expressly stated here.

The Service supports the care your organization provides; it does not provide that care. Nothing in the Service is professional medical, mental health, or legal advice, and it is not a substitute for the judgment of a qualified professional.

โš–๏ธ 11. Limitation of liability

To the fullest extent permitted by law, Soul Care Dashboard and Gospel Soul Care Ministries will not be liable for any indirect, incidental, special, or consequential damages, or for lost data, revenue, or goodwill, arising from your use of the Service. Where liability cannot be excluded, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

๐Ÿคฒ 12. Your responsibility for your use

You agree to be responsible for your own use of the Service, including the care you provide, the data you handle, and your compliance with the laws and professional duties that apply to you. If a claim is brought against us because of your misuse of the Service or your handling of the people and data in your care, you agree to cover the reasonable costs we incur, to the extent the law allows.

๐Ÿšช 13. Ending your use

You may stop using the Service and close your account at any time. We may suspend or end access if these Terms are seriously or repeatedly broken, or if we must do so to protect the Service or other people.

When an organization's account is closed, you will have a reasonable window to request an export of your data before it is deleted, after which it is removed except for anonymized records that accounting or law requires us to keep. We will describe the export and deletion process when you ask to offboard.

๐Ÿ“ 14. Changes to these terms

As the Service grows, we may update these Terms. If a change is significant, we will give reasonable notice, for example by posting the update here with a new date or by contacting you. If you keep using the Service after a change takes effect, that means you accept the updated Terms.

๐Ÿ›๏ธ 15. Governing law

These Terms are governed by the laws of the state in which Gospel Soul Care Ministries is established, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be handled in the courts located there, unless the law requires otherwise.

Soul Care Dashboard is a ministry and soul care platform, not a medical or insurance-billing system, and we do not market it as HIPAA compliant. These Terms describe how we work together; they are not legal advice for your ministry. Your situation is your own, and you should check with your own legal and ministry advisors about what applies to you.
